SMSF Technical Update Podcasts

SMSF Technical updates are audio podcast updates on SMSF Radio where we look at what is happening in the world of SMSFs, particularly from a technical viewpoint. This will include updates on rules, laws, and announcements from the Government or regulator on changes that may be occurring.

These are all MP3 files and so will play on just about anything.

November 2013

This technical update podcast for November 2013 covers the rules and regulations that the new Federal Government have said they are going to keep from the previous Government, and which they are going to remove. It also covers ATO TD 2013/22, which is to do concessional contributions made in one year, but allocated to a member account in the next year.

The technical update podcast for March 2013 covers the new regulations introduced regarding insurance inside your SMSF, and also where house and land packages under a limied recourse borrowing arrangement may require multiple payments.

October 2012

The technical update for October 2012 covers two new ATO IDs. The first one deals with concessional contributions from the commutation of a Lifetime complying pension, where the pension amount rolled over to a market linked pension, but the reserve amount rolled over to an account based pension. The second one deals with whether or not multiple in-specie contributions of listed shares that happen on the same day can be counted as one contribution for the purpose of "fund capped" contributions. We also tee off on the nonsense going around in the past month on suspected changes to SMSFs that have been appearing in the media.

September 2012

The technical update for September 2012 covers the new requirements for all SMSF trustees when formulating their SMSF investment strategies. Plus there are new provisions around valuing the fund's assets, and keeping the assets of the fund separate from your own personal assets.

August 2012

The technical update for the month of August 2012 covers the pushing back of the start dates of numerous previously announced measures from the Stronger Super reforms. Plus a few other issues from SISFA.

June 2012

The technical update for the month of June 2012 covers the release by Treasury of the latest round of Stronger Super reforms. This includes trustees needing to consider insurance as part of their SMSF investment strategy, money and other assets of an SMSF be kept separate from money and assets held by a trustee personally, and for SMSFs to value the assets of the fund at “net market value” for reporting purposes. The update also covers the ATO final ruling on SMSF borrowing issues, and a few other issues.

May 2012

Technical update for the month of May 2012. This covers the changes in the Federal budget with specific reference to the deferral of the higher concessional contributions cap for members age 50 and over, and the increase in contributions tax for high income earners. Plus an update on SISFA submissions.

Technical update for the month of April 2012. Just a short one this month, covering the recent ATO ID on transfers of foreign pension transfers. We also just touch on the legislation before parliament that will be pertinent to SMSFs.

March 2012

Technical update for the month of March 2012. In this episode, we cover the new ATO Interpretative Decisions from the past month. This includes a decision on anti-detriment payments where only a portion of the death benefit is paid to dependents of the deceased, and answers the question of whether the full anti detriment amount needs to be paid out, or just the same proportion. There is also a decision dealing with concessional contributions where they are paid to a SMSF in one financial year, but allocated in the following financial year.

February 2012

Technical update for the month of February - our first for 2012 - covering a number of announcements that were made at the end of last year, but are due to be implemented this year, some of which are yet to be legislated. Key among these is the dropping of the concessional contribution cap from $50,000 to $25,000 for those with an account balance of over $500,000. Plus a whole lot more.

December 2011

Technical update for the month of December, covering the announcements during the month around the extension of drawdown relief for account based pensions, abolition of the SGC age limit, and Government annoucements on intentions for next year. It also covers (in a seperate audio file) the withdrawal of a previous tax payer alert to do with using clauses in a trust deed to try and circumvent excess contributions limits. Note we had a couple of technical glitches this month so it is split into two audio files.

Technical update for the month of November covering a umber of ATO interpretative decisions that came out. This included whether a former spouse from a same sex couple can be a death benefits dependant, whether former step children can be paid out a death benefit from a SMSF as a dependant, and whether or not a SMSF can acquire an asset with an existing charge over it.

Technical update for the month of October, covering the ATOs long awaited draft which seeks to clarify its position on a number of contentious issues around SMSF borrowiing, particularly to do with borrowing to invest in property.
